The State does not have any authority over a Theological University that grants degrees only in Religion. The Federal Government does not have any authority over Theological Universities or even secular Universities.
Here is a Quote from the U.S. Department of Education's Web Page:

Under the Tenth Amendment of the U.S. Constitution: "The powers not delegated to the United States by the constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Nothing specific is said about education in the Constitution; therefore it falls outside federal authority.
In creating the Department of Education, Congress made clear its intention that the secretary of education and other Department officials be prohibited from exercising "any direction, supervision, or control over the curriculum program of instruction, administration, or personnel of any educational institution, school, or school system." The establishment of schools and colleges, the development of curricula, the setting of requirements for enrollment and graduation -- these are responsibilities handled by the various states and communities, as well as by public and private organizations of all kinds, not by the U.S. Department of Education."

MTU Accreditation Information
There is great controversy over the issue of accreditation. Our students may place a great emphasis on accreditation and other students place no emphasis on accreditation.
Though MTU! is not accredited at this time, it has obtained authorization to conduct the business of the seminary. In order to obtain this authorization, MTU! has committed to, and is actively pursuing, accreditation.
There are a number of accrediting agencies, that are approved by the United States Department of Education and agencies that are not. MTU! takes the position that those agencies approved by the United States Department of Education are the most substantial and will better serve our students.
It will take MTU time achieve accreditation. This is true for any educational institution.
We will begin the process of accreditation as soon as possible to commit to our students to pursue legitimate accreditation. We commit to our students that we will vigorously pursue accreditation from appropriate agencies that have been approved by the United States Department of Education. In the meantime, we pledge to structure our tuition accordingly and to seek private funding for scholarships.
Although we believe that accreditation is not necessary in order for Millennial Theological University, or any legitimate learning institution, to deliver an excellent educational product and, though we believe accreditation is not necessary for most other legitimate opportunities for students, accreditation IS important to our students. Because it is important to our students, it is important to MTU!
